Terms
Effective October 2, 2026.
These terms are a contract between StreamLeadX and the business that uses the service or the website to inquire about it. StreamLeadX is operated by David Melendez, a sole proprietor in California. "StreamLeadX," "we," and "us" mean that business. "You" means the client business, and the person who accepts these terms represents that they have authority to bind that business. The service is offered for business use, not for personal or household use.
By creating an account, paying a fee, forwarding calls, or otherwise using the service, you agree to these terms, the Privacy Policy, and the SMS Policy. If you do not agree, do not use the service. People who only call your shop and receive a text are not parties to these terms. Their messages are described in the SMS Policy.
The service
StreamLeadX is an AI SMS receptionist for service businesses. You keep your own business number. You set up conditional (no-answer) call forwarding on that line so unanswered calls reach a dedicated StreamLeadX number for your business. We can walk you through those steps. Your carrier, not StreamLeadX, controls your line. Answered calls stay on your line.
Texts are sent from your dedicated StreamLeadX number. They are not sent from your shop's own phone line, and StreamLeadX does not take over that line. The AI replies from the information you configure, collects lead details, and sends you a summary. You can take over the conversation. Text-back is available 24/7. Staffing your shop, and answering your own line, remain your responsibility.
Fees, billing, and cancellation
The service is a monthly subscription. There is no setup fee. The monthly price and monthly conversation allowance for each plan are as listed on this website and at signup. The first month is charged at signup. If we agree with you on a different plan in writing, that plan's price applies. Fees are in U.S. dollars. If the law requires us to collect a tax, that tax is additional. Your phone carrier may charge you separately for call forwarding. That carrier charge is not a StreamLeadX fee.
Service is month to month. There is no long-term contract. You can cancel anytime, and cancellation takes effect at the end of the current billing period. There is no minimum term. The billing period is the period on your invoice or, if the invoice does not state one, the month that begins on your signup date and each monthly anniversary after that. Each billing period is billed in advance. Fees already paid for the current billing period are not refunded, except where the law requires a refund. You still owe fees incurred before the cancellation takes effect.
If a payment is late, we may suspend the service until it is paid. A Founding plan's monthly price stays the same for as long as that shop stays subscribed. We may change the prices of other plans with at least 30 days' notice by email. The new price applies at the start of the next billing period after that notice. If you do not agree to a price change, you may cancel before it takes effect.
Plan usage and fair use
Each plan includes a monthly allowance of missed-call conversations and messages as described on that client's plan. If a plan states a numeric allowance, use above it may be billed at the then-current overage rate or may require an upgrade. If a plan is described as unlimited, it is still subject to fair use.
Fair use means conversational follow-up for your own customers, such as a text after a missed call. It does not include spam, bulk marketing blasts, or reselling the service to others. We may throttle or suspend use that we reasonably believe is abusive, unlawful, deceptive, or outside the service.
Your responsibilities
You are responsible for your business and for how the service is used for it. You will:
- Comply with the Telephone Consumer Protection Act (TCPA), CTIA messaging principles, and carrier rules that apply to your business and to messages sent for you, including consent and registration requirements
- Give us accurate business information, including your name, services, hours, prices, and FAQ answers, and keep it current
- Use the service only for lawful communication with your own customers and prospects
- Set up and maintain call forwarding on your own number, and keep the authority to do so
- Honor STOP, HELP, and other opt-outs, and not ask us to text a number that has opted out
- Review AI replies and correct anything you do not want said to your customers
AI responses
Replies are produced by automated systems. They may be inaccurate, incomplete, or out of date. StreamLeadX does not guarantee leads, bookings, appointments, or revenue. You are responsible for quotes, prices, appointment promises, and any other commitment made to your customers, whether you sent it or the AI drafted it. You will not treat an AI reply as legal, financial, or safety advice.
Not for emergencies
The service is not an emergency service and is not a substitute for 911 or for a person answering your phone. Do not use it for emergencies. StreamLeadX does not monitor conversations for emergencies and may not see or answer an urgent message in time. If you or your customer need emergency help, call 911.
SMS
Checking the box on the website form is consent to receive SMS messages related to that inquiry. The box is optional, and submitting the form does not require it. Text messaging is also described in the SMS Policy and the Privacy Policy. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help.
Mobile numbers and SMS opt-in consent are not shared with or sold to third parties or affiliates for marketing or promotional purposes.
Acceptable use
You will not use the service to send unlawful, deceptive, or unwanted messages, to impersonate another business, to harvest phone numbers, or to interfere with the site or the service. You will not submit payment card numbers, government IDs, or health information for us to store. We may suspend or terminate service that creates carrier, legal, or abuse risk.
Third-party services
The service depends on third parties, including Twilio, OpenAI, n8n, Vercel, Google Workspace, and phone carriers. Their outages, filtering, and rule changes can delay or block calls and texts. Carrier filtering and message delivery are not guaranteed. StreamLeadX is not a phone carrier and does not control whether a carrier delivers a message or on what schedule. A2P 10DLC registration is part of setup where it applies, and carrier review timing is outside our control. We do not promise a specific setup time.
Intellectual property and data
StreamLeadX owns the service, the website, the software, and the StreamLeadX name and branding. These terms do not give you ownership of any of that. You receive a limited, non-exclusive right to use the service during a paid period, for your own business, under these terms.
You keep ownership of your business information and of the customer information collected for you. You grant StreamLeadX a limited license to host, copy, and process that information only to provide, secure, and support the service, to send you lead summaries, and to meet legal duties. We do not sell your customer data. Retention and deletion are described in the Privacy Policy. You are responsible for having the rights and notices needed to let us process caller information for you.
Confidentiality
Each party will use the other's non-public business information only to perform under these terms and will protect it with reasonable care. This duty does not cover information that is public through no fault of the receiving party, that the receiving party already knew, that it developed independently, or that it must disclose by law. You may share a conversation with your own customer as part of the job. We may share information with the processors named in the Privacy Policy and when the law requires it.
Disclaimer of warranties
The website and the service are provided "as is" and "as available." To the fullest extent the law allows, StreamLeadX disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the service will be uninterrupted, error-free, or that any message will be delivered. Some jurisdictions do not allow a disclaimer of certain warranties, and in those jurisdictions the disclaimer applies to the fullest extent allowed.
Limitation of liability
To the fullest extent the law allows, StreamLeadX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost leads, lost calls, lost data, or carrier filtering, even if we were advised that those damages were possible.
To the fullest extent the law allows, StreamLeadX's total liability arising out of these terms or the service will not exceed the fees you paid to StreamLeadX for the service during the three months immediately before the event giving rise to the claim. This limit does not apply to liability that cannot be limited under applicable law, or to StreamLeadX's fraud or willful misconduct.
Indemnification
You will defend, indemnify, and hold harmless StreamLeadX and David Melendez from claims, damages, losses, liabilities, and reasonable attorneys' fees arising out of your business or your customers; the information and configuration you provide; messages sent for you; your call-forwarding setup; quotes or commitments made to your customers; or your breach of these terms or of TCPA, CTIA, carrier, or other applicable rules. We will give you prompt notice of a claim. A delay in notice relieves you only to the extent you are materially prejudiced. You will not settle a claim in a way that admits fault by StreamLeadX or imposes an obligation on StreamLeadX other than payment of money you fully cover, unless we agree in writing.
Termination
You may cancel as described under fees. We may stop offering the service at the end of a billing period with notice by email. We may suspend or end the service immediately if you do not pay, if you materially breach these terms, or if continued service would create legal, carrier, security, or abuse risk. When the service ends, text-back stops. Sections that by their nature should continue, including unpaid fees, intellectual property, data licenses needed for deletion and legal compliance, confidentiality, disclaimers, limitation of liability, indemnification, governing law, and arbitration, remain in effect.
Changes to these terms
We may update these terms. We will post the updated terms on this page, change the effective date, and, for a material change that affects a paying client, email the address we have on file at least 30 days before the change takes effect. If you keep using the service after that date, you accept the updated terms. If you do not agree, cancel before the change takes effect. A price change is handled under the fees section.
Governing law and arbitration
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
You and StreamLeadX agree that any dispute, claim, or controversy arising out of or relating to these terms or the service will be resolved by binding individual arbitration, except that either party may bring an individual action in small claims court in Los Angeles County, California, if the claim qualifies for that court. The Federal Arbitration Act governs this arbitration agreement. Arbitration will be administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be held in Los Angeles County, California, before one arbitrator. The arbitrator may award only individual relief that a court could award. Judgment on the award may be entered in a court of competent jurisdiction.
You and StreamLeadX waive any right to a jury trial and any right to bring or participate in a class, collective, or representative action. The arbitrator may not preside over a class, collective, or representative proceeding. If a court finds the class-action waiver unenforceable as to a particular claim, that claim proceeds in court and the rest proceeds in arbitration.
Either party may ask the state or federal courts located in Los Angeles County, California, for temporary or preliminary injunctive relief to protect intellectual property or confidential information, or to compel or confirm arbitration. Subject to this arbitration agreement, venue for court proceedings lies in Los Angeles County, California.
Severability
If a provision of these terms is held unenforceable, the rest remains in effect. If limiting a provision would make it enforceable, it is limited to the minimum extent required.
Entire agreement
These terms, the Privacy Policy, the SMS Policy, and any plan or order you accept are the entire agreement between you and StreamLeadX about the service. They replace earlier oral or written statements about the same subject. If a plan or order states a different price or usage allowance, that statement controls for the price or allowance only. It does not change the warranty, liability, indemnity, or dispute terms unless a writing signed by StreamLeadX says so.
